™ and ® in the UK

Written by Just Trademark It. Not legal advice. We are not the UK IPO and not registered trade mark attorneys.

™ and ® are not the same, and neither one is a substitute for a UK trademark application.

When to use ™

™ means you are treating the name or logo as a brand. You can use it before an application is filed and while an application is being examined. It does not mean the mark is registered, and it does not create that registration.

When ® is allowed

® means the mark is on the register. In the UK it is an offence to use ® for a trademark that is not registered. Wait until you have the registration, then the symbol is honest. Until then, ™ is the one to use.

How long that wait usually is, after filing, is covered in how long UK trademark registration takes.

Search the name, or start the application

You will see the service fee and the official UK IPO fee before you pay. Nothing is filed until a person has reviewed it.
